Premises Liability Claims

In many instances, assault incidents at bars and nightclubs happen because of negligent security and premises liability concerns. Individuals who visit a bar, restaurant, or other business that is open to the public should reasonably expect that the premises will be free and safe from all hazards and defects. When premises owners fail to warn about or correct premises defects, and a patron is injured on the premises, then the premises owner could be held responsible for any resulting injuries and damages.

More specifically, in the State of California, business owners are required to provide all of the following on their premises:

  • Working locks
  • Sufficient lighting
  • Adequate staffing
  • Well-trained and experienced security guards

In the event a bar bouncer or security guard does not properly take action to prevent a patron from suffering harm caused by another guest, then the premises owner could be liable for the injuries and damages that result from the incident. The same could be true if a security guard or doorman uses excessive force in the process of removing a boisterous guest from the bar – or when a security guard physically attacks a bar patron.

History of Violence at a Bar
